President's Message
Legally Speaking
In my capacity as a longstanding member of The Association of Condominium Managers of Ontario (ACMO), and pursuant to the duties and obligations herewith, I find it both pertinent and pressing to formally address the managers, assistant managers, administrators, regional managers, management company owners, guests, and all other parties of interest (hereafter collectively referred to as “us”), concerning the multifarious and ever-evolving complexities that arise, from time to time, within the scope and ambit of condominium management (hereafter referred to as “work”).
I am herefore presenting this President’s Report, prefacing the theme of said episode, drafted in the traditional parlance of legalese, to underscore the inestimable value and critical importance of our legal-minded brethren. These esteemed colleagues, acting without prejudice, have proffered their invaluable advice, insight, and counsel, which is encapsulated herewith. It is with due diligence and due deference that I pen the subsequent discourse, and I entreat your indulgence for any protracted sentences interspersed hereafter.
As has been duly recognized and noted herein before, we are inevitably engaged in a myriad of intricacies that span the gamut from the nuanced administration of shared facilities to potential contractual disputes that may arise. These challenges also encompass the arduous regulatory mandates that emanate from occupational health and safety, provisions under the AODA, and the intricate machinations of the Condominium Tribunal (CAT). It is neither hyperbolic nor without foundation to postulate that the prevailing landscape mandates a perspicacious and discerning approach.
It is incumbent upon us, in our collective capacity, to express our profound appreciation to the manifold condo law firms. Their unparalleled expertise has, on numerous occasions, provided the essential legal bulwark to our collective endeavours. However, in the face of the economic vicissitudes wrought by inflation, it has been brought to our attention that boards may, from time to time, envisage that managers shall be entrusted with a more paramount, if not pivotal, role in the aforesaid affairs.
Recognizing the mutable nature of our responsibilities, ACMO is unwavering in its pursuit to ensure that managers are not merely equipped with foundational knowledge but are also buttressed with the advanced acumen that such roles inexorably demand by providing continuing education modules astutely tailored to address the emergent exigencies of the industry.
Be it known that, fortified with the quintessential knowledge and an indomitable professional alliance, we shall indubitably navigate and surmount any challenges that may obtrude upon our path from time to time.
