Background: The Condominium Management Services Act, 2015, requires the CMRAO to handle complaints about licensed condo managers and licensed condo management provider firms. A possible process to deal with a complaint is having allegations of breaches of the condo management Code of Ethics heard by a panel of the CMRAO Discipline Committee. The final order of a panel of the CMRAO Discipline Committee may be appealed by the complainant or the licensee, and the appeal is heard by a panel of the CMRAO Discipline Appeals Committee.
Functions: Members of the Discipline Appeals Committee sit as a panel of at least three members to hear and consider evidence and determine if the final order of the Discipline Committee panel was fair based on the evidence. A panel of the Discipline Appeals Committee may affirm the original order of the Discipline Committee or may overturn or modify it or substitute it. The panel may substitute an order for further education of the licensee or of the principal condominium manager of a licensed condo management provider; impose a fine on the licensee; and fix and impose costs of the discipline proceeding on the licensee. Panel members will write the panel’s decisions and reasons. The panel will be assisted by an Independent Legal Counsel to conduct the hearing in accordance with prescribed procedures and policies. CMRAO Discipline Appeals Committee members will affirm or swear an oath of office related to executing their duties impartially and faithfully, and holding information confidential as required by law.
Members: A minimum of 5 committee members will be selected. Members may be condo managers, designated principal condo managers, officers or directors of a condo management company. At least one member of the committee and of each panel must be a lay person who has not been an employee, shareholder, officer or director of a condo management provider firm or a licensed condo manager.
Term: up to 3 years with possible reappointment at the end of the term
Meetings: as needed for orientation and hearings
