Update on Condominium Act Amendments and Supporting Regulations

Good Afternoon,

First, we would like to thank you for participating in recent and past consultations regarding proposals to bring certain provisions of the Condominium Act, 1998 (Condo Act) into force, with supporting regulations, related to owner-requisitioned meetings and non-leased voting units, as well as proposed regulatory amendments to expand the jurisdiction of the Condominium Authority Tribunal.

Your feedback and insights were greatly appreciated and played an invaluable role in the development of these changes.

We are pleased to inform you that the government has filed the following:

  1. An Order in Council to proclaim into force, on December 31, 2026, certain provisions of the Protecting Condominium Owners Act, 2015 (Schedule 1) that amend the Condo Act with respect to non-leased voting units and owner-requisitioned meetings.
  2. Amendments to O. Reg. 48/01 (General) under the Condo Act, which come into force on December 31, 2026. These amendments replace provisions relating to "owner-occupied units" with provisions relating to "non-leased voting units," support a new process for owner-requisitioned meetings, and make housekeeping amendments to remove outdated provisions.
  3. Amendments to O. Reg. 179/17 (Condominium Authority Tribunal), which come into force on July 1, 2027. These amendments expand the Tribunal's jurisdiction to include certain disputes related to owners' meetings.
